Clearworks is committed to maintaining robust privacy protections for its users.  Our Privacy Notice is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.  We are a customer-centric, business-to-business market research and insights firm.  Our website provides no consumer services; therefore, we do not actively collect, share or sell consumer information.  We do collect contact information for those persons or organizations who fill out Contact Us form to seek additional information on our services.

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at www.clearworks.net.  “Service” refers to the Company’s market research, innovation and customer experience services which are delivered independent of our website. The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Site or our Service.

By accessing our Site, you accept our Privacy Notice and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Notice.

Information we collect

In general, the personal information you provide to us is used to help us communicate with you. For example, when you communicate with us, for example by email to ask us questions, fill out a form, or contact us to explore a potential business relationship, we collect your name, email address, and other personal information you choose to provide. If you sign an engagement letter Clearworks, we collect additional information needed for billing and payment. If you apply for a job with us, we collect the information contained on your resume along with other information you provide in the course of the application process. We also receive information from or on behalf of our clients. Because of the nature of our services, this could include any type of personal data.

Information collected automatically. As further described in the Cookies and Similar Technologies section below, when you use our online services some information is collected automatically. For example, when you visit our website, our web servers automatically log your computer’s operating system, Internet Protocol (IP) address, access times, browser type and language, the website you visited before our site, and your activity on our websites.

Third-party sources. We occasionally obtain information from third parties. These third-party sources include:

  • Applications and services, such as social networks that make users’ information to others
  • Partners with which we jointly provide services

When you are asked to provide personal information, you may decline. However, if you choose not to provide information that is necessary for us to provide our services, it may impair our ability to provide those services to you or disqualify you from a research study.

The Site and the Service are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13.  In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. Information we share

We do not share personal information collected on our site with anyone.

We do not sell and will not sell personal data or consumer information. We share personal information with vendors or agents working on our behalf for the purposes described in this statement. For example, companies we’ve hired to provide accounting services, website hosting, and cloud-based office productivity services may need access to personal information to provide those functions. In such cases, these companies must abide by data privacy and security requirements and are not allowed to use personal information they receive from us for any other purpose. We may also disclose personal information as part of a corporate transaction such as a merger, transfer, divestiture, or sale of all or a portion of our business or assets.

Finally, we will access, transfer, disclose, and preserve personal information when we have a good faith belief that doing so is necessary to:

In an effort to improve the quality of the Site and our Services, we track information provided to us by your browser when you view or use the Service, such as the website you came from (known as the “referring URL”),.

Security
We take reasonable and appropriate steps to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction.

Storage

If you participate in a research study we keep your data for up to 18 months or as is appropriate to the purpose for which we collected it. Any video, audio or photographic data embedded in final client work product, may be retained by our clients per each one’s written data privacy policy.  Once this time period has expired, we will delete your data by erasing it from our systems.

Third countries

Our website and offline services are operated in the United States. If you are located in the European Union, UK, or elsewhere outside of the United States, please be aware that any information you provide to us will be received in or transferred and stored in the United States. By using our website or Offline Services and/or providing us with your personal information, you consent to this transfer. We utilize the standard contractual clauses published by the European Commission in June 2021 to ensure there is a legal basis to transfer personal data from the EEA to the United States and other countries. We have also adopted contract language for the United Kingdom, in accordance with British ICO guidance.

Your privacy rights

At Clearworks we strive to apply the same data rights to all customers, regardless of their location. Some of these rights include:

  • Right to Know. You have the right to know what personal information is collected, used, shared or sold. We outline both the categories and specific bits of data we collect, as well as how they are used, in this Privacy Notice.
  • Right of Access. This includes your right to access the personal information we gather about you, and your right to obtain information about the sharing, storage, security and processing of that information.
  • Right to Correction. You have the right to request correction of your personal information.
  • Right to Erasure / “To Be Forgotten”. This is your right to request, subject to certain limitations under applicable law, that your personal information be erased. Fulfillment of some data deletion requests may prevent you from using our products or services because our applications may then no longer work. In such cases, a data deletion request may result in closing your account.
  • Right to Restrict Processing. This is your right to request restriction of how and why your personal information is used, processed, or shared, including opting out of the sale of personal information.
  • Right to Object. You have the right, in certain situations, to object to how or why your personal information is processed.

We will respond to your request within a reasonable time, and we may require additional information from you to allow us to confirm your identity and review your personal data. After we have confirmed your relationship with us and have the proper authorization, we will respond to your request in further detail.

You will not be discriminated against or otherwise penalized for exercising your rights. Please note that we must retain certain information related to the request itself as part of our legal records. We also retain anonymized information, as much as may be possible, in order to maintain the accuracy of our records for compliance with applicable law or to manage ongoing business requirements like financial reporting.

The Company reserves the right to change this policy and our Terms of Service at any time.  We will post on our website significant changes to our Privacy Notice. You are responsible for periodically checking the Site and this privacy page for updates.

As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Notice applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Notice does not apply to your use of a third-party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application.
